The Upper Area Court in Ganmo resolved a property possession dispute between Alhaji Tajudeen and Remi Afusat Alabi on Monday, February 26, 2024.
As per the case brief presented in court, Alhaji Tajudeen asserted his claim to a four-bedroom flat located in the Ero Omo Ajegunle area, off Sanmora Road, Ilorin, Kwara State.
Meanwhile, Remi Afusat Alabi had been residing in the property as a tenant at will under a mutual agreement stipulating her final evacuation by October 24, 2023.
Represented by her daughter, Oluwatosin Alabi, the defendant acknowledged her mother’s agreement to vacate the premises, yet pleaded for an extension until May, citing the need for ample time to hand over possession.
However, the plaintiff’s lawyer, I.B. Abdulkadir, countered the defendant’s plea by emphasizing the necessity for immediate renovation of the property due to escalating material prices, which would result in losses for his client.
Following deliberations, the presiding judge, Honorable Adam Suleimon, rendered a verdict. He ordered Remi Afusat Alabi to surrender possession of the house to the plaintiff by April 30th, adding that the aggrieved party had the right to appeal within thirty days.
