The Federal High Court sitting in Abuja has issued an order preventing the Independent National Electoral Commission (INEC) from conducting by-elections for the 27 defected lawmakers from the Peoples Democratic Party (PDP) in Rivers State.
In the suit, the lawmakers sought an order restraining INEC and other parties from declaring their seats vacant or taking any steps toward that end.
According to Punch, they also requested the court to prohibit INEC from organizing new elections until the motion on notice is heard and resolved.
Justice Donatus Okorowo, delivering the judgment on December 15, ordered a halt to the withdrawal of the lawmakers’ respective Certificates of Return and barred INEC from conducting fresh elections for their seats until the motion on notice is heard and determined.
