A Federal High Court in Abuja has adjourned two separate suits filed by former Senate President, Bukola Saraki, against the Economic and Financial Crimes Commission (EFCC) and other agencies.
Dailypost gathered the adjournment comes as the court awaits the report of the Court of Appeal on the application for a stay of proceedings filed by the ex-lawmaker.
Justice Inyang Ekwo made the announcement in a short ruling, stating that the adjournment was necessary until the Court of Appeal provides its report on Saraki’s application for a stay of proceedings.
Upon the resumption of the hearing, Saraki’s lawyer, Tunde Afe-Babalola, SAN, informed the court about a pending application for a stay of proceedings filed on July 30, 2021. Afe-Babalola mentioned that all parties had been served and expressed readiness to proceed.
Ekenma Okafor, representing the Code of Conduct Bureau (CCB), mentioned that his client had not been served and recalled a previous statement from Saraki’s counsel indicating the withdrawal of their appeal. Afe-Babalola, unaware of Okafor’s information, stressed the pending nature of the motion.
In response, Justice Ekwo questioned why a stay had been filed at both the Federal High Court and the Court of Appeal. He emphasized that if a stay is granted at the Federal High Court, it fulfills the duty at the Court of Appeal.
“I remember on one of the sittings, the counsel appearing for the applicant had given the court his word that he is withdrawing their appeal.
“We are surprised with this development,” Okafor said
